- II. The owner
agrees:
-
- A. Owner will make all
arrangements for the following and assume the costs thereof.
-
- 1. Health Certificate dated within
30 days of transport destination date. Only the original forms will be
accepted. (Required if traveling out of state.)

- 2. Negative Coggins (EIA) Test
within 6 months of transport destination date. Only the original forms
will be accepted.
- (Required if traveling out of

- 3. Brand Inspection Certificate

- B. Owner will select one of three
choices of insurance.
- Owner will maintain and provide
proof of current horse mortality insurance, or
- Purchase haul/trip insurance from
an insurance agent, or
- Owner elects not to carry horse
mortality insurance and assumes ALL risks therein (to include but not
limited to; injury, illness or disease, physical damage or harm).

- D. Owner will

- (1) pay the Transporter the
sum of $ ________

- (2) reimburse the transporter
for all veterinary services, drugs and other medical supplies in the
event of an emergency or as the transporter deems necessary for the
well-being of the aforementioned horse (s); and

- (3) layover is available on
non-direct trips. Owner agrees to pay $ ________ per day for boarding
(if applicable).

- E. A deposit of at least 50% of
the shipping fee is due in advance of the trip, along with this
completed and signed agreement form. Your deposit may be paid by
credit card, money order, cashier check, and personal or business
check (up to 14 days prior to transport). To pay your deposit by
credit card please click here. The balance of the shipping fee may be
paid in advance, at pickup, or at delivery Prior to unloading of any
horses. The balance must be paid by cash, money order, or credit card.
If the balance is paid by credit card at time of delivery there will
be a 3% charge. There is no fee if your balance is paid upfront or by
cash or money order.

- F. Transporter shall be entitled
to a lien against the transported horse (s) for possible sale at
auction to recover charges
- and expenses associated with
collection of original invoiced amount and other contractually agreed
expenses. Lien to be placed in compliance with local and state
regulations.

- Other Charges
-
- The rate you are quoted is for
door to door delivery and care of your horse (s). However, a surcharge
may apply for any of the following:
-
- Tack charges range from $25.00 for
a small tack trunk or saddle to $50-$100 for very large and heavy tack
- trunk. If not pre-scheduled, the
driver has the discretion of whether to transport the tack.
- A change of pick-up or delivery
location from that quoted may be subject to a surcharge.
- Waiting time at the barn for the
horse (s), pick-up or delivery person will be charged at a rate of $30
per hour after the first 10 minutes of waiting.
- Any toll roads fees associated
with pickup and drop-off locations.
- Difficult access roads to the
location will have a surcharge if not disclosed at the time of booking
and in the original quote. The surcharge will depend on the difficulty
of the road and the additional time to reach the location.
- A "hard loader fee" of $40.00 per
hour may be applied after the first 15 minutes of attempted loading or
unloading per horse, billed in 30 minute increments.
- Any damage to the trailer or
equipment caused by your horse (s).
- A fee of $75 will be applied to
any returned check.
- In the event we arrive at the
pick-up location and are unable to transport your horse (s) because of
the lack of required paperwork; misrepresentations; or we are unable
to safely load your horse after using diligent efforts to safely load
50% of the shipping fee will be retained.

- All cancellations must be
submitted in writing by email bscott@maremeadows.com, and a phone call
to 352-463-1337 Prior to 7 days of the arranged pickup date, a $50
processing fee would apply. Less than 7 days of the arranged pickup
date, but prior to 24 hours of trip, 30% of shipping fee. Less than 24
hours of the trip, 50% of shipping fee, unless it is below $350 and
then the full amount is due.

- Transporter reserves the right to
cancel trip due to hazardous weather, mechanical difficulties,
unfulfilled bookings or extenuating circumstances. A full refund shall
be made if this occurs.

- It is agreed that in the event of
a riot, war, Act of God, governmental regulations, or other causes
beyond the reasonable control or the parties, which event makes
performance under this Agreement impossible, the terms of this
Agreement shall be suspended during the period of such events or acts
and neither party shall be liable to perform.

- III. The
transporter agrees:
-
- A. Transporter will use due
diligence to safely transport, feed and care for the aforementioned
horse (s), but makes no guarantees as to the health or physical
condition of the horse (s) upon departure or arrival.
-
- B. Transporter will use due
diligence to safely transport, feed and care for the aforementioned
horse (s) in a good and husband-like manner, feeding grass hay and
grain. Feed will be charged at $5.00 a day per horse if no hay is
provided. All other types of feed shall be provided by the owner of
the horse (s). If supplements are to be fed they need to be in
individual pre-packed rations for the duration of the trip.

- C. Every effort will be made to
pick-up and deliver horse (s) on suggested dates/times. We cannot be
held responsible for delays caused by traffic, detours, threat of poor
weather, poor road conditions or any emergency horse or animal health
needs that may arise along the trip route.

- D. Transporter agrees to provide
services to Owner as described herein under contract, in equipment
designed to meet Owner's needs as provided herein, at the rates set
forth herein. Delivery instructions shall be prepared by the Owner and
followed as closely as is reasonable under the circumstances by the
Transporter. Delivery of the horse (s) tendered for transport to
Transporter shall be evidenced by a pick-up and delivery receipt
prepared by the Transporter and signed by the Transporter, Owner and
Consignee or its agents or employees at the loading and unloading
points respectively.

- IV. In the event the horse (s)
require the service of a veterinarian, the transporter will
immediately notify the owner. In the event the owner cannot be
reached, the transporter is hereby authorized as agent for the owner
to call the first available licensed veterinarian of his/her choice.
All fees charged by said veterinarians shall be the sole and exclusive
responsibility of the owner (s), with no liability whatsoever on the
transporter for such fees or charges.

- Release
-
- Owner hereby voluntarily releases
and forever discharges the transporter and its agent from any and all
liabilities, claims, demands, actions or right of actions, which are
related to, rise out of, or are in any way connected with the
transport of the aforementioned horse (s), including, but not limited
to the negligent acts of omissions of the transporter, its agent or
employees and all other persons or entities, for any and all injuries,
death, illness, or disease and damage to the aforementioned horse (s),
including all third party claims. Owner further agrees, promises and
covenants not to sue, assert or otherwise maintain to assert any
claims against the transporter or its agents or employees, for any
injury, death, disease or damage to the aforementioned horse (s)
arising from or in connection with the transportation, care or feeding
of said horse (s) or for any claims asserted by other third parties.

- Owner understands and acknowledges
that insurance is not provided to the owner by the transporter, if the
owner elects not to secure insurance, then he/she assumes all expenses
or liabilities that would incur or associated with the transport of
care of the aforementioned horse (s).

- Owner hereby holds harmless
J.R. Acord, her auto insurance and home owners insurance and Bar
A Ranch for any liability that would incur for property damage or
bodily injury to any horse (s) and/or owners/passengers while loading,
transporting, unloading or handling of the aforementioned horse (s).

- Entire Agreement
-
- No modification of this agreement
and no waiver of its terms shall be valid or binding unless in writing
and signed by all parties. The owner understands that this is the
entire agreement between the owner and the transporter, its agent or
employees, and that it supersedes and cannot be modified or changed in
any way by the representations or statements of any employee or agent
of the transporter or owner.
